Article 1 - Agreement
1.1 The following terms and conditions, which also include our Privacy Policy (collectively, “Terms of Service”), are a binding legal agreement between you and AUTO SLAVIC d.o.o. (hereinafter “Auto Slavic” or “Us” or “We”) regarding your use of Auto Slavic’s games, websites and services.
1.2 This agreement applies to slavicminiseries.com, any other Auto Slavic websites, any and all Auto Slavic games including Cosmic Paradox, Galactic Strike, Space KaBAAM, Space KaBAAM 2,Space KaBAAM 3, Auto Slavic blogs, social media accounts, customer and technical support and any other services We provide to you (Can be summarised as “Auto Slavic’s Games and Services” or “Our Games and Services”).
1.3 The agreement is binding on you and Us once you use any of Auto Slavic’s Games and Services. If you do not agree to it, you are not permitted to use Auto Slavic’s Games and Services.
1.4 Certain sections of the Terms of Service and its Privacy Policy may be changed, modified, added or removed at any time at Auto Slavic’s discretion. Your acceptance of any changes will be indicated by your continued use of Auto Slavic’s Games and Services. If at any point you do not agree with any segment of the current version of the Terms of Service, the Privacy Policy, any other policy or rules of conduct, you shall immediately stop using Auto Slavic’s Games and Services, as your license will be terminated by not accepting the Terms of Service.
1.5 All Auto Slavic video games have their own age rating (e.g. ESRB, PEGI, IARC). These ratings will differ depending on where you are located and are always displayed on the digital storefront where you can purchase the game.You should only play our games if you meet the applicable minimum age rating. If you are above the applicable minimum age rating and you are over 18 (or the equivalent adulthood age in your country) then you may enter into this agreement and you can play our games. If you are under 18 (or the equivalent adulthood age in your country) please ask your parent or guardian to review and approve this agreement on your behalf (in some countries individuals under a certain age cannot legally fully enter into contracts such as this Agreement). Your parent or guardian should supervise your use of the games, even if you meet the minimum applicable age rating.
Article 2 - License
2.1 We grant you this personal, limited, revocable, non-exclusive, non-transferable and non-assignable license to display, view, download, install, play and use Auto Slavic’s Games and Services on your personal computer, games consoles and/or other devices/platforms specifically authorised by Us. This license is for your personal use only (you can't give, lend, sell, gift, assign, sub-license or otherwise transfer it to another individual), it doesn't give you ownership rights in Auto Slavic’s Games and Services.
Article 3 - Patches, Updates and Changes
3.1 Every now and then We will have to patch or update Our Games and Services to resolve bugs, balance our games and add/or remove features.This could lead to mandatory and/or automatic updates after which older, non-updated versions may become unusable or certain features may become unavailable (e.g. Leaderboards). This is required in order to ensure that Our Games and Services work as intended.
Article 4 - Ownership
4.1 Auto Slavic’s Games and Services, including (but not limited to) their artwork, animations, characters, story, designs, music and sound effects, dialogue, graphics, code, user interface, look and feel, game mechanics, gameplay, audio, video, data and all other content are either owned by Us or are licensed from third parties. You may not use or exploit any part of Our Games and Services except as explained in this Agreement.
4.2 We respect the intellectual property rights of others. If you believe that your work has been infringed by Our Games and Services, please contact Us via support@autoslavic.com
Article 5 - Usage of Our Games and Services
5.1 We expect all users to follow the rules regarding usage of Auto Slavic’s Games and Services. Failure to do so will be considered a breach of this agreement, which can lead to suspension and/or termination of access to Our Games and Services. Should a specific case require more drastic measures, we also reserve the right to prohibit your future access to Our Games and Services.
Rule #1
Personal Enjoyment: Only use Our Games and Services for your personal enjoyment and not for any commercial purposes, unless explicitly authorised by Us.
Rule #2
Technical Misuse: Please don’t modify, merge, distribute, translate, reverse engineer, attempt to obtain or use source code of, decompile or disassemble Our Games and Services – unless specifically authorised to do so by our written permission.
Rule #3
Hacking and cheating: Do not create, use, make available and/or distribute cheats. This includes (but is not limited to) exploits, bots, automation software, robots, hacks, spyware, scripts, extraction tools, trainers or other software that can interact with and affect Our Games and Services.
Rule #4
Service interference: Do not deliberately or maliciously interrupt or interfere with our services like customer or technical support or impersonate our staff.
Rule #5
Systems interference: Don't deliberately or maliciously interfere with, disrupt or access restricted areas of our network or that of our partners. This includes tunnelling, code injection or insertion, denial of service, modifying or changing the software, using any other similar software together with our own, protocol emulation, or through creation or use of private servers.
Rule #6
Data Mining: Do not intercept, mine or otherwise collect personal or confidential data or information from Our Games and Services.
Rule #7
Malicious Code: Do not upload any files that contain any malicious code, including viruses, spyware, Trojan horses, worms, time bombs, intentionally corrupted data, any other files that contain malicious code or that may in any way damage or interfere with the operation of Our Games and Services.
Rule #8
No Transfer: Do not attempt to copy, rent, buy, sell, lend, share, lease, sublicense, transfer, distribute, publish or publicly display Auto Slavic’s Games and Services or any of your rights under this agreement in any way not expressly authorised by this Agreement. Additionally, do not steal or misappropriate game keys/codes, these remain our property and were created for a specific purpose by the platform holder.
Rule #9
Names: Do not use Auto Slavic’s name or logo or the names and logos of Our Games and Services for any unauthorised purposes.
Rule #10
Behaviour: Don't do or say anything or use Our Games and Services in any way that is or may be considered abusive, defamatory, offensive or illegal. If any such content is posted on our blog, we reserve the right to remove it with no prior notice.
Rule 11#
Applicable Law: You must comply with all applicable laws and regulations when using Our Games and Services.
Rule 12#
Geographic Restrictions: We ask you to follow any applicable geographic or regional, language or location-based restrictions, requirements or rules regarding Our Games and Services.
5.2 Seizure warning: Some of Our Games and Services may contain flashing lights and images, which may induce epileptic seizures. If you or anyone in your household has an epileptic condition, please consult your doctor before using Auto Slavic’s Games and Services. If you experience dizziness, disorientation, loss of awareness, altered vision, involuntary movement, or convulsions while playing, immediately discontinue use and consult your doctor.
Article 6 - Feedback and Crash reports
6.1 If something goes wrong with Our Games and Services, we may ask you to send a crash report in order to improve the game code for future use. These reports are optional and may include some personal data (for more information, please read our Privacy Policy).
Article 7 - Third party content
7.1 You might get links from Us to third party websites or content through Our Games and Services. It is also possible to access Our Games and Services through different devices, systems or platforms. These may also be subject to their own legal terms which we highly suggest reading before using them. We cannot ensure that third party content will work as intended and will not accept any liability should that be the case.
Article 8 - Warranties and liability
8.1 We warrant that:
I - We have the right to enter into this Agreement and to grant you the license to use Our Games and Services.
II - We will take reasonable care with Our Games and Services and your use of them.
III - We will use reasonable endeavours to comply with applicable laws in performing our obligations to you under this Agreement.
8.2 Liability - We will always do our best to ensure that Our Games and Services work properly. Unfortunately, it is always possible to overlook something and not get everything right. As such, we cannot accept any liability or responsibility if Our Games and Services do not work fully or completely. Additionally, we are not responsible or liable for anything that happens to Our Games and Services outside of reasonable control.
Article 9 - Termination
9.1 Your Termination Rights - You can terminate this agreement by permanently stopping use of Our Games and Services at any time. Termination will not affect already existing rights or obligations to Us or you.
9.2 Our Termination Rights - We may cancel or suspend your access to Our Games and Services if you breach this agreement. This particularly applies to a serious breach which could cause real harm to Our Games and Services, our users, Auto Slavic and its partners. To avoid breaching this agreement, refer to the rules detailed in Article 5. Should a breach occur, We will try to contact you if possible to explain our decision and to inform you if there is anything that you can do. Should We suspend or cancel your access to Our Games and Services We will no longer have any obligations or liabilities towards you.
9.3 Stopping any of Our Games and Services - If We have to partially or fully stop providing access to any of Our Games and Services, We will try to notify you at least one hundred and twenty (120) days in advance on our website or social media. Should this be the case, We will no longer have any future obligations or liabilities to you. This, however, does not affect any pre-existing obligations or liabilities.
Article 10 - Disputes and Governing Law
10.1 Should a dispute arise between you and Auto Slavic, We strongly encourage you to contact us directly. We will do our best to try and find a resolution. You can reach us at support@autoslavic.com
10.2 You agree that your use of Our Games and Services, and this Agreement, will be governed by and interpreted according to the laws of Croatia and any dispute regarding it will be exclusively under the jurisdiction of the courts of Croatia.
Article 11 - Additional Legal Information
1.1 Entire Agreement - This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Us regarding this Agreement and supersedes any earlier oral or written agreements.
11.2 Severability - If any part of this Agreement is found not to be legally enforceable, this will not affect any other part of it.
11.3 Other Laws - Please remember that We are subject to various laws and We may be required to comply with law enforcement or other legal requirements.
11.4 No Third Parties - This Agreement governs our relationship with you. It does not create any rights for anyone else unless explicitly stated otherwise in this Agreement.
11.5 Delay - No failure or delay by Us or you to exercise any right or remedy provided under this Agreement or by law will constitute a waiver of that or any other right or remedy, nor will it preclude or restrict the further exercise of that or any other right or remedy, unless explicitly stated otherwise in this Agreement. No single or partial exercise of such right or remedy by Us or you will preclude or restrict the further exercise of that or any other right or remedy.
Article 12 - Changes to this Agreement
12.1 Changes - We may change this Agreement if We think it’s necessary. This can be for legal reasons or to reflect changes in Our Games and Services. If so, We will make the changed Agreement available online and make reasonable efforts to tell you about it.
12.2 Binding Date - Once We change the Agreement, it will become legally binding on you 30 days after We post it online.
12.3 Disagreement with Changes - If you don't agree with any of the changes, then We will have to ask you to stop using Our Games and Services.
Article 13 - Force Majeure
13.1 Neither of us will be liable for any failure to perform any obligation under this Agreement or to provide access to Our Games and Services if that failure is caused by the happening of any unforeseen event beyond our reasonable control. This includes, without limitation: internet and communication outages, terrorism, riots, embargoes, acts of civil or military authorities, pandemics, fire, floods, accidents, strikes, war or act of God.
